The present General Terms and Conditions of Sale are effective since the new version was put online on the website www.europaventure.be on January 01, 2021.

2. Application of the General Terms and Conditions of Sale

2.1. The General Conditions of Sale are concluded between, on the one hand, Europ’Aventure and, on the other hand, any individual or legal entity wishing to make a purchase on the Europ’Aventure site, hereinafter referred to as “the customer”.

2.2. The General Conditions of Sale define the sales process between Europ’Aventure and the Customer, the terms of order, payment, delivery of the product ordered.

2.3. The confirmation of the order and thus the purchase of one or more products implies full and complete acceptance of the General Terms and Conditions of Sale described here, the fact of having read them perfectly and of renouncing to make other conditions prevail.

2.4. The General Terms and Conditions of Sale are applicable during the entire time the site is online.

2.5. Europ’Aventure reserves the right to modify, at any time, its General Conditions of Sale. Orders placed prior to the modification are not affected by the said modification.

3. Products offered for sale on the Site www.europaventure.be

3.1. The products offered for sale online on the site are: maps, books, topo-guides, roadbooks, carriers. They are accessible via the “Books and Maps” section.

3.2. These products are available for sale while stocks last.

3.3. The visuals proposed to illustrate the products are as representative as possible; however, perfect similarity cannot be ensured by the visual concerned.

4. Opening an account

4.1. The Customer who wishes to place an Order on the site declares that he/she is at least 18 years of age and has full legal capacity or parental authorisation to place an order on the site at the time of placing the order.

4.2. Any person who is incapacitated can in no way place an order via the site. The consultation of the site and the services it offers are then under the responsibility of its legal representative.

4.3. The user who wishes to register on the site and purchase one of the products offered for sale online will have to create an account on the site by filling in all the required fields: surname, first name, email address, user name and password.

4.4. The opening of an account on the site www.europaventure.be allows the customer to access the functionalities of the said site and to order one or more products. In case of loss of his password, the customer can send an email by clicking on “forgotten password”. The customer will receive a new password in return. The customer can modify his account and his personal data whenever he wishes and if he wishes via the “my account” section.

4.5. The customer is responsible for keeping his password confidential. Therefore, the customer agrees to take reasonable measures to prevent others from obtaining the password and to warn Europ’Aventure by email or telephone if the password is no longer confidential.

5. Awards

5.1. The prices indicated are prices in euros, including VAT, taking into account the rate applicable on the day of the order. Any change in the rate may be reflected in the price of the products ordered.

5.2. The prices indicated do not include shipping / delivery costs.

5.3. The prices indicated on the day of the order are applicable. Nevertheless, Europ’Aventure reserves the right to modify the prices indicated on the website at any time.

5.4. Promotions on products are valid only within the limit of the validity period of the promotion concerned and the availability of stock.

5.5. The price of transport depends on the weight of the order and is calculated via the site.

6. Order, confirmation, delivery

6.1. Order

6.1.1. On the website www.europaventure.be, the customer selects the product(s) and the quantity he wants. This selection is saved in the Shopping Cart. The Customer will access it via the “Shopping Cart” tab.

6.1.2. In the shopping cart, by clicking on “Order”, the customer will follow the five steps required to finalize his order

– Summary: summarizes the products selected for the order

– Login: Login using the customer’s account information (username and password)

– Address: delivery and billing address (several addresses can be encoded)

– Shipment : indications on the method of shipment (collection at Europ’Aventure or sending by post)

– Payment: validation by the customer of his choice of order.

6.1.3. The customer who places the order is recognized as the only person responsible for the order and its payment, even if the order is placed in favour of a third party.

6.2. Terms of payment and order confirmation

6.2.1. To finalize his order, the customer validates the last order step (see article 6.1.2), after having checked his order. He then makes the payment.

6.2.2. The products offered for sale online on the Europ’Aventure website are to be paid by bank transfer in advance to Account BE28 3601 1301 6120.

6.2.3. Europ’Aventure confirms the acceptance of his order to the customer by email only after receipt of payment. The sale will be concluded and binds Europ’Aventure only from the confirmation of the order by Europ’Aventure (the email will include the following information: products ordered, price).

6.2.4. The products ordered remain the property of Europ’Aventure as long as the price has not been fully and definitively paid by the customer.

6.2.5. The customer can check the status of his order online at any time and if he wishes to do so, by logging into his account using his username and password.

6.3. Shipping of products

6.3.1. The customer has the possibility, free of charge, to come and collect the product at the Europ’Aventure office by prior appointment. To do this, when ordering, the customer has chosen the delivery method “In-store pick-up”.

6.3.2. If the customer does not choose the delivery method “Withdrawal in store”, then, for any order in payment order and confirmed by Europ’Aventure, the order will be shipped to the address specified when ordering as soon as possible.

6.3.3. The products ordered are shipped in a single order.

6.3.4. If a product is out of stock, it is not possible to take an option for restocking.

6.3.5. If the customer omits or refuses to take delivery of the products ordered, Europ’Aventure reserves the right to demand the execution of the contract or to consider, after prior formal notice, the contract as automatically terminated. In this case, the product relating to the cancellation of the order by the customer is applicable.

7. Warranties and liability of Europ’Aventure

7.1.Europ’Aventure undertakes to prepare the orders the day of their arrival and to send them within 72 hours of receipt of payment.

7.2. Europ’Aventure declines all responsibility for any direct or indirect damage, whatever the cause, origin, nature or consequences, caused by the access of anyone to the site, or the impossibility of accessing it, the use of the site and/or the credit given to any information coming directly or indirectly from the site.

If any inconvenience or damage inherent to the use of the Internet network (for example: interruption of service, computer virus or any other fact qualified as force majeure) should occur, the responsibility of Europ’Aventure cannot be engaged.

7.3. The products travel at the expense, risk and peril of the customer, except fraud or gross negligence on the part of Europ’Aventure or its employees. Europ’Aventure disclaims any responsibility in case of excessive delivery time and in case of loss of packages or strike.

7.4. In case of transport problems, the customer will have to file a claim with the carrier only.

8. Right of withdrawal, cancellation

8.1. Withdrawal

8.1.1. The consumer has the right to withdraw without giving any reason within fourteen days.

8.1.2. In order to exercise this right of withdrawal, the consumer must inform the business of his wish to withdraw from the contract within fourteen calendar days from the day following the day on which he or a third party designated by him takes physical possession of the goods.

8.1.3. The consumer shall inform the business of his decision to withdraw from the contract, before the expiry of the withdrawal period of 14 calendar days, by sending either completed and signed withdrawal form or an unambiguous statement clearly stating his decision to withdraw from the contract by post or e-mail to the address given above. A written acknowledgement of receipt will then be sent without delay to the consumer by Europ’Aventure.

8.1.4. In case of withdrawal, Europ’Aventure will refund all payments received from the consumer, no later than fourteen days from the day Europ’Aventure is informed of the withdrawal. Europ’Aventure will contact the consumer in order to agree on the desired means of reimbursement. This refund will not generate any costs for the consumer.

8.1.5. The consumer must return or send back the good to the address of Europ’Aventure indicated above, at the latest, 14 days after the notification of withdrawal. The direct costs of returning the goods will be borne by the consumer. The Product concerned must be returned to Europ’Aventure in the unopened envelope/package.

8.1.6. Europ’Aventure may defer the reimbursement until it receives the Product subject to withdrawal.

8.1.7. A consumer who gives notice of his decision to withdraw from the contract when performance of the contract has begun will have to pay the business an amount proportional to the services provided by the business up to the time when the consumer informed the business of his decision to withdraw from the contract in relation to all the services provided for.

8.1.8. The consumer will not be able to withdraw from the contract if the withdrawal period is not respected.

8.2. No order confirmation and cancellation

8.2.1. Europ’Aventure reserves the right not to confirm / cancel an order for any reason whatsoever (supply of products, lack of availability, abnormal order or foreseeable problem of delivery).

8.2.2. Europ’aventure also reserves the right to cancel the order if the payment is not received within 7 days of the order.

8.2.3. In case of cancellation of the order of a product by Europ’Aventure, Europ’Aventure will reimburse the customer within fourteen days of the announcement of the impossibility to complete the order if the payment had already been made.

9. The settlement of disputes

These online sales conditions are subject to Belgian law.In case of dispute, the courts of the registered office of Europ’Aventure are competent.
